Äldre har samma rättigheter som alla andra, och all svensk lag ska uppfylla kraven i de EU- och FN-konventioner som Sverige har skrivit under. Ramverken för äldres rättigheter består framförallt av icke bindande instrument, som FNs Deklaration 2002 för ett gott åldrande i ett samhälle för alla åldrar. Ålder är en diskrimineringsgrund och äldres rättigheter måste förtydligas och förstärkas.
